Terms of Service

1. Eligibility and Accounts

1.1 Age: You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is higher.

1.2 Signing In: You sign in to Talon with your Discord account. You may also connect a Twitch account to enable team features. Your use of those accounts is also governed by Discord's and Twitch's own terms.

1.3 Server Authority: You may only add Talon to, or configure Talon for, a Discord server where you have permission to manage the server. If you set Talon up on behalf of a community, stream team or organization, you represent that you have its permission to do so.

1.4 Security: You are responsible for keeping your Discord and Twitch accounts secure. We are not liable for loss or damage caused by unauthorized use of your accounts.

2. The Services and Your License

2.1 What Talon Does: Talon monitors Twitch streamers and stream teams you choose and posts announcements to Discord channels you choose. This includes go-live notifications, end-of-stream recaps with VODs, clips and raids, daily team summaries, and public streamer and team pages on this site.

2.2 License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services for your own community.

2.3 Restrictions: You may not (and may not let anyone else): reverse engineer, decompile or attempt to discover the source code of the Services; scrape or bulk-download data from the Services by automated means; resell, rent or offer the Services to others as a service; interfere with, overload or bypass any limits or security measures of the Services; or remove any proprietary notices.

3. Your Responsibilities

3.1 Platform Rules: You must follow the Discord Terms of Service, Discord's Community Guidelines, the Twitch Terms of Service, and all applicable laws.

3.2 Your Server: You decide which streamers and teams are monitored and where announcements are posted. You are responsible for moderating your own server and channels.

3.3 Prohibited Uses: You may not use the Services to harass, spam, impersonate, or track people in ways they would not reasonably expect, or for any illegal or unauthorized purpose.

4. Stream Content, Public Pages and AI Summaries

4.1 Stream Content: Stream titles, categories, thumbnails, clips, VODs and profile images shown by Talon come from Twitch and belong to their respective owners. Talon displays them as provided by Twitch.

4.2 Public Pages: Talon publishes public pages for monitored streamers and teams, showing stream history, rosters and clips. These pages may be indexed by search engines. A streamer who wants their page removed can ask through our contact form.

4.3 AI-Generated Summaries: Some recaps and daily summaries are written automatically using a third-party AI service. They may be incomplete or inaccurate, and they do not reflect our views or the views of any streamer. We may turn AI summaries off at any time.

5. Fees and Paid Features

5.1 Current Pricing: Talon is currently free to use.

5.2 Future Paid Features: We may introduce paid plans or features. We will give at least 30 days' notice through the Site, the dashboard or Discord before any feature you are already using requires payment. We will never charge you without your explicit agreement.

5.3 Payment Processing: If paid features are introduced, payments may be processed by third parties such as Discord or Stripe, and you agree to their terms when you pay through them. Fees are non-refundable except where required by law or by the payment platform's own refund policy.

6. Intellectual Property

6.1 Our Rights: Andolyx LLC owns all right, title and interest in and to the Services, including the software, the Talon name and logo, and the design of the Site.

6.2 Your Settings: Your server configuration remains yours. You grant us a license to store and use it to provide the Services.

6.3 Feedback: If you send us ideas or suggestions, we may use them without any obligation to you.

7. Third-Party Platforms

7.1 Dependence on Platforms: Talon relies on Discord, Twitch and other third-party services. Their outages, rate limits, subscription limits, policy changes or API changes can delay, limit or stop parts of the Services, and we are not responsible for them.

7.2 No Affiliation: Talon is not affiliated with, endorsed by, or sponsored by Discord, Twitch or Google. Their names and logos are trademarks of their respective owners.

8. Term and Termination

8.1 Leaving: You can stop using Talon at any time by removing the bot from your server, and you can delete your account from the Account page.

8.2 Suspension by Us: We may suspend or end your access to the Services, or remove Talon from a server, at our discretion and without notice, including for conduct we believe violates these Terms or harms other users, us or third parties.

8.3 Effect: When your access ends, your license ends. We handle your data as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. ANDOLYX LLC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANNOUNCEMENTS WILL BE DELIVERED ON TIME, ONLY ONCE, OR AT ALL.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANDOLYX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, AUDIENCE, GOODWILL OR DATA.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50).

11. Indemnification

You agree to indemnify, defend and hold harmless Andolyx LLC from any claim arising out of (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) how you use the Services in your server.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute shall be resolved exclusively by the state or federal courts with jurisdiction over Snohomish County, Washington.

13. Changes to the Services and These Terms

13.1 Service Changes: We may add, change, limit or discontinue any part of the Services at any time, with or without notice.

13.2 Changes to These Terms: We may update these Terms. We will post the new version here with a new effective date and, for material changes, give reasonable notice through the Site or dashboard. Continuing to use the Services after the effective date means you accept the updated Terms.

14. General Conditions

14.1 Severability: If any provision is found unenforceable, it will be severed and the rest will remain in effect.

14.2 Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Services.

14.3 No Waiver: Not enforcing a provision does not waive our right to enforce it later.

14.4 Assignment: You may not transfer these Terms without our written consent. We may assign them without restriction, including in a merger, acquisition or sale of assets.

14.5 Force Majeure: Neither party is liable for delays or failures caused by events beyond its reasonable control, including outages of Discord, Twitch, hosting or internet providers.

14.6 Notices: We may give you notice through the Site, the dashboard or Discord. Notices to us must be sent through our contact form.

15. Copyright Complaints (DMCA)

15.1 Twitch Content: Clips, VODs and thumbnails shown by Talon are hosted by Twitch. To have that content removed at its source, use Twitch's DMCA process.

15.2 Notices to Us: If you believe content on Talon's own pages infringes your copyright, send a notice through our contact form marked "DMCA Notice" that includes: (a) your physical or electronic signature; (b) the copyrighted work; (c) the infringing material and where it appears; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner.
